Terms of use

1. About these terms

These terms of use ("Terms") are an agreement between you and Vulkan ("Vulkan", "we", "us"). They apply to the Vulkan website, Vulkan Hub, the programs offered in Vulkan Hub ("products"), Vulkan's Discord server and everything else Vulkan provides (together, the "Service").

By signing in to Vulkan Hub, using the Service, redeeming a key or making a purchase, you accept these Terms, the Refund policy and the Privacy policy. If you don't accept them, don't use the Service.

Vulkan reserves all rights not expressly granted to you in these Terms.

2. Who can use Vulkan

You must be at least 18 years old, or the age of majority where you live if that is higher. If you are younger, you may use the Service only with the permission of a parent or legal guardian, who accepts these Terms for you and is responsible for your use of the Service, including purchases.

You may not use the Service if the law where you are prohibits it, or if you are subject to sanctions that prohibit dealing with you. You are responsible for making sure that your use of the Service, including paying with cryptocurrency, is lawful where you are.

Vulkan reserves the right to refuse the Service to anyone, at any time, at its sole discretion.

3. Your account

You sign in to Vulkan Hub with your Discord account. You are responsible for keeping your Discord account and your computer secure, and for everything done with your account.

Use only one account, and don't use another account to get around a suspension, a limit or these Terms.

Vulkan reserves the right to restrict, suspend or close any account at its sole discretion.

4. Licenses

When you buy a product or redeem a key, Vulkan grants you a personal, limited, non-exclusive, non-transferable and revocable license to use that product through Vulkan Hub for the license period. You receive a license to use the product, not the product itself. The products, Vulkan Hub and the Service remain the property of Vulkan and its licensors; all rights reserved.

A license is either timed (for the period chosen at purchase) or lifetime. "Lifetime" means for as long as Vulkan provides the product, not for your lifetime.

Products can be used only through Vulkan Hub and only under the conditions Vulkan sets, including limits on devices and on simultaneous use. Vulkan may set and change these conditions at any time.

Vulkan uses technical measures to protect the products and the Service and to verify licenses. You must not interfere with them.

Vulkan may update, change or remove features of any product, withdraw it from sale or stop providing it, at any time, at its sole discretion and without liability; whether any credit is given is decided by Vulkan. Vulkan doesn't promise that a product will work with your computer, its configuration or other software.

5. Rules of use

You must not, and must not help anyone else to:

• share, sell, rent or lend your account or a license, or let others use a product through your account
• sell or trade keys unless you are an approved Vulkan reseller (you may give keys you bought as keys to someone else)
• copy, modify, crack, decompile, disassemble or reverse engineer a product, Vulkan Hub or any other part of the Service, except where the law expressly allows it
• circumvent, disable or interfere with any protection, license check, limit or security measure of the Service
• access, copy, extract or run a product outside Vulkan Hub
• attack, probe, overload or disrupt the Service, or use bots or scripts against it, except where Vulkan allows it
• exploit errors, for example in payments, the balance, keys or licenses, instead of reporting them; anything gained this way may be reversed
• use the Service or the products for anything illegal, to infringe the rights of others, or to harm, deceive or harass anyone
• pretend to be Vulkan staff or another person, or give false information
• sell or trade Vulkan+ invites, or share Vulkan+ exclusive products or content outside Vulkan+

Vulkan decides at its sole discretion whether these rules have been broken. If they have been, Vulkan may take the measures in section 14 and may claim compensation for the damage caused, including through legal action. All rights reserved.

6. Prices and payment

Purchases are made only in Vulkan Hub. Prices are in US dollars. Vulkan may change prices, minimum amounts, payment methods and payment conditions at any time; an order keeps the price shown when it was placed.

Payments are made in cryptocurrency through the payment provider NOWPayments, whose terms also apply. The payment details shown in Vulkan Hub are valid only for a limited time, and unpaid orders expire.

You are responsible for sending the full amount, in the coin and on the network shown, to the address shown, before it expires. Network, wallet and exchange fees are paid by you. Cryptocurrency transactions can't be reversed: payments sent on the wrong network, to the wrong address or in the wrong coin may be lost, and Vulkan is not responsible for such losses or for changes in the value of cryptocurrencies.

An order is completed only when Vulkan has verified the payment. Telling us that you paid doesn't complete an order. Amounts received that don't match an order, such as too little, too much or too late, may be credited to your balance at Vulkan's discretion.

An order bought "as a key" gives you single-use keys instead of a license. Anyone with a Vulkan account can redeem a key, and the license is opened on their account. Keep your keys safe: whoever has a key can use it.

Keys bought from a reseller are paid to that reseller, not to Vulkan. Vulkan is not a party to that sale and isn't responsible for the reseller's prices, payment methods or delivery. Keys obtained through fraud or in breach of these Terms may be revoked.

Vulkan reserves the right to refuse or cancel any order at its sole discretion.

7. Balance

Your balance is store credit for purchases in Vulkan Hub. It is not money, a deposit or an e-money account: it can't be withdrawn, paid out, exchanged for money or transferred to another account, and it earns no interest.

Top-ups are not refundable. Vulkan may correct your balance at any time, including by removing credit that came from a reversed or invalid payment or from an error. If your account is closed because you broke these Terms, any remaining balance is forfeited.

8. Vulkan+

Vulkan+ is a paid membership available by invitation only. Joining requires an invite, a written application, approval by Vulkan and payment of the entry fee. Vulkan decides on applications at its sole discretion and doesn't have to give reasons.

Membership lasts for the period shown when you pay and is extended by paying the renewal fee. Buying or extending Vulkan+ exclusive products requires an active membership.

Invites are personal and must not be sold or traded. Vulkan+ exclusive products, news and content are for members only and must not be shared outside Vulkan+.

Vulkan reserves the right to change the conditions, prices and benefits of Vulkan+ and to end any membership at any time, at its sole discretion. If you break these Terms, Vulkan may end your membership and revoke licenses for exclusive products without a refund.

9. Resellers

Resellers are independent sellers approved by Vulkan. They are not Vulkan's employees, agents or partners, and they can't make promises or accept obligations on Vulkan's behalf.

Reseller prices, minimum quantities and conditions are set by Vulkan and may change at any time. Keys issued from a reseller's balance are not refunded if they are revoked.

Resellers are responsible for their own sales: their prices, payment methods, delivery, customer support, refunds to their customers, taxes and compliance with the law. They must describe the products and Vulkan truthfully and must not use Vulkan's name or logo in a misleading way. Reseller API keys are confidential, and the reseller is responsible for everything done with them.

Vulkan reserves the right to approve, suspend or end reseller status at any time, at its sole discretion. Keys sold in breach of these Terms, or obtained through fraud, may be revoked.

10. Content you provide

You are responsible for what you write or upload: vouches, support tickets, applications, attachments and messages on Vulkan's Discord server. It must be truthful and lawful, must not infringe anyone's rights and must not contain other people's personal data without their permission. A vouch must describe your own experience.

You give Vulkan a worldwide, royalty-free, non-exclusive license to store, use, copy and display that content to provide the Service, and to publish approved vouches with your Discord display name, username and profile picture on the website, in Vulkan Hub and on Vulkan's Discord server. For a vouch, this license ends when you remove it, except for copies kept in Vulkan's records.

Vulkan reserves the right to review, refuse or remove any content at its sole discretion. Ideas and feedback you send us may be used freely, without compensation.

11. Discord

Signing in uses Discord, and Discord's own terms apply to your Discord account. By signing in, you allow Vulkan to add you to Vulkan's Discord server. You can leave the server at any time.

On Vulkan's Discord server, Discord's rules and the server's rules apply. Vulkan reserves the right to moderate the server at its sole discretion, including deleting messages and timing out, kicking or banning members.

Vulkan may send you direct messages on Discord about your account, tickets, licenses, orders and applications; you can turn them off in Vulkan Hub.

12. Third-party services

The Service relies on third parties such as Discord, NOWPayments, blockchain networks, wallets and exchanges, and Microsoft Windows. Their terms apply to your use of them, and Vulkan isn't responsible for their availability, actions or errors.

If you use a product together with other software, platforms or services, you are responsible for complying with their terms. Vulkan isn't responsible for measures they take against you, such as restricting your account with them.

13. Availability of the Service

Vulkan may change, suspend or discontinue the Service or any part of it, including products, features and payment methods, at any time, with or without notice, and without liability. Vulkan doesn't promise that the Service will be available, uninterrupted, secure or free of errors.

14. Suspension and termination

You can stop using the Service at any time.

Vulkan may, at any time, at its sole discretion and without notice, suspend or revoke licenses, keys, memberships or reseller status, remove content, end sessions, close accounts or refuse the Service, in particular if you break these Terms, if Vulkan suspects fraud, sharing, piracy or other abuse, if the law requires it, or to protect Vulkan, its users or others.

If Vulkan takes these measures because you broke these Terms, you aren't entitled to a refund, credit or compensation. Provisions that by their nature should continue (for example sections 5, 7 and 15 to 22) continue to apply after your use of the Service ends.

15. Intellectual property

© Vulkan. All rights reserved. Vulkan Hub, the Vulkan name and logo, the products, the website and their content are protected by intellectual property laws and belong to Vulkan or its licensors. These Terms give you no rights other than the license in section 4. Don't use Vulkan's name or logo without permission.

If you believe something on the Service infringes your rights, contact us with the details (section 23).

16. No warranties

The Service and the products are provided "as is" and "as available". To the fullest extent permitted by law, Vulkan gives no warranties of any kind, express or implied, including warranties of merchantability, fitness for a particular purpose, non-infringement, availability or freedom from errors. You use the products at your own risk; keep backups of your data.

If you are a consumer, this doesn't affect the rights that the law gives you and that can't be excluded.

17. Limitation of liability

To the fullest extent permitted by law, Vulkan is not liable for indirect, incidental, special, consequential or punitive damages, for loss of profits, revenue, data, goodwill or use, or for damage to your computer or to your accounts with other services, arising from the Service or the products, even if Vulkan was told that such damage was possible.

To the fullest extent permitted by law, Vulkan's total liability for all claims relating to the Service is limited to the amount you paid to Vulkan in the 12 months before the event that gave rise to the claim.

Nothing in these Terms limits liability for intent or gross negligence, for death or personal injury caused by negligence, for fraud, or any other liability that can't be limited by law.

To the extent permitted by law, claims must be brought within one year after they arise.

18. Indemnity

You will compensate Vulkan for, and protect it against, claims by others, losses, damages and reasonable costs (including legal fees) arising from your breach of these Terms, your misuse of the Service or the products, your content, or your violation of the law or of anyone's rights. If you are a consumer, this applies only where you are at fault and to the extent permitted by law.

19. Events beyond our control

Vulkan is not responsible for delays or failures caused by events beyond its reasonable control, such as outages of the internet, hosting, Discord or payment providers, blockchain network congestion, attacks, natural disasters, war or acts of authorities.

20. Changes to these Terms

Vulkan may change, add to or remove any part of these Terms at any time, at its sole discretion. Changes take effect when they are published on the website, unless Vulkan states otherwise. If you keep using the Service after a change, you accept the changed Terms; if you don't agree, stop using the Service. Each purchase is made under the Terms in force at that time, which you accept on the payment screen.

21. Disputes and governing law

If you have a complaint, you agree to contact us first (section 23) and to try to resolve it informally before going to court.

These Terms are governed by the law of the place from which Vulkan operates the Service, excluding its conflict-of-law rules and the UN Convention on Contracts for the International Sale of Goods, and disputes are decided by the courts of that place. If you are a consumer, you also keep the protection of the mandatory laws of the country where you live and can bring proceedings in its courts where those laws allow it.

To the extent permitted by law, claims may be brought only individually, not as part of a class or representative action.

22. General

These Terms, the Refund policy and the Privacy policy are the entire agreement between you and Vulkan about the Service. Where these Terms give Vulkan a right or a decision, Vulkan may exercise it at its sole discretion. If a provision is invalid or can't apply in full, it applies to the maximum extent permitted, and the rest remains in effect. If Vulkan doesn't enforce a provision, it doesn't give up the right to do so later.

You may not transfer your rights or obligations under these Terms. Vulkan may transfer its rights and obligations, together with your account, to another person or company that takes over the Service (for example, a company set up to operate Vulkan).

These Terms are written in English, and the English version applies. The website and Vulkan Hub are also available in other languages for convenience; the legal texts are published only in English.

Vulkan may send you notices in Vulkan Hub, in News or by Discord direct message. Vulkan reserves all rights not expressly granted in these Terms.
